Terms of Service

Welcome to MapCheck! These Terms of Service ("Terms") govern your use of the MapCheck mobile application and related services (collectively, the "Service") provided by MapCheck ("MapCheck," "we," "us," or "our").

By creating an account or using MapCheck, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

To use MapCheck, you must:

• Be at least 17 years of age
• Have a valid email address; a .edu address is not required for World play
• Have the legal capacity to enter into these Terms

By using MapCheck, you represent and warrant that you meet all eligibility requirements. Campus play additionally requires a verified email address from a supported school.

3.1 Account Creation

You must create an account to use MapCheck. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 One Account Per Person

Each person may only have one MapCheck account. Creating multiple accounts, sharing accounts, or selling accounts is prohibited.

You agree NOT to:

• Use GPS spoofing, location mocking, or any method to fake your location
• Use bots, scripts, or automated methods to interact with the Service
• Create fake check-ins or manipulate territory control
• Harass, threaten, or abuse other users
• Post or transmit content that is offensive, harmful, or illegal
• Impersonate another person or organization
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service for any illegal purpose
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

5.1 Check-In Requirements

You must be physically present within the venue's allowed radius and provide a fresh, accurate location. A valid plant earns 10 points immediately. An optional hold earns 5 more points after at least 10 minutes, with another valid location check at the venue. We use GPS and other signals to verify your location. The app shows the applicable location requirements and any additional scoring rules.

5.2 Territory Control

Territory control is determined by a rolling 7-day points system. The allegiance with the most points controls the territory. We reserve the right to modify the scoring system at any time.

5.3 Limits

We may impose limits on check-ins, including:

• Daily check-in limits
• Cooldown periods between check-ins at the same venue
• Rate limiting to prevent abuse

6.1 University Allegiance

A supported school is assigned from your verified .edu email domain for Campus play. World play is open to all eligible account holders, including alumni and non-students.

6.2 Additional Allegiances

You may fly up to 5 player banners and create up to 3 banners. Eligible new banners are created immediately and occupy one of your banner slots. You can choose which banner is active for a plant. Campus banners require eligibility at the same school.

6.3 Allegiance Names and Content

Custom allegiance names must not be offensive, misleading, or infringe on any trademark or intellectual property rights. Do not include links, abusive or prohibited content, or claims of official or verified status. Automated checks are limited and do not verify a group's identity or rights to a name.

Player banners, including featured alumni groups, do not imply official affiliation or endorsement. MapCheck is independent of the schools and organizations named. School and organization names and trademarks belong to their respective owners.

Partner venues may offer rewards and promotions through MapCheck. These are subject to:

• Availability and venue participation
• Expiration dates and redemption limits
• Venue-specific terms and conditions

MapCheck is not responsible for the fulfillment of rewards by partner venues.

8.1 Our Property

The Service, including all content, features, and functionality, is owned by MapCheck and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

8.3 User Content

You retain ownership of content you submit. By submitting content, you grant us a worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

9.1 By You

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

9.2 By Us

We may suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination, your license to use the Service ends.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, MAPCHECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless MapCheck and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

13.1 Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

13.2 Arbitration

Any dispute arising out of these Terms shall be resolved by binding arbitration in Athens, Georgia, in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

• Entire Agreement: These Terms constitute the entire agreement between you and MapCheck regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign these Terms without our consent. We may assign these Terms freely.
